1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of OmniBiz AI, including the website at getomnibizai.com and all related services (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Your Account

You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. You must be authorized to act on behalf of any business you represent and to upload the customer contact lists you submit to the Service.

3. Subscriptions and Billing

Paid plans are billed monthly in advance through Stripe. Plan tiers, features, and upload limits are displayed on the billing page. You may upgrade or cancel at any time; cancellations take effect at the end of the current billing period. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice, and changes take effect at the next renewal.

4. Acceptable Use

You agree to use the Service only for lawful business purposes and to comply with all applicable laws, including those governing email marketing, SMS marketing, and consumer protection. You may not misuse the Service, upload data you do not have rights to, send messages to recipients who have not consented, or attempt to disrupt or reverse engineer the platform.

5. SMS Messaging Consent

Registering a business workspace on OmniBiz AI constitutes consent to receive automated system alerts and operational notifications. The following program terms apply to your use of any OmniBiz AI feature that sends text messages, including Bulk SMS Promotions and AI Voice Receptionist automations:

You are solely responsible for obtaining and documenting opt-in consent from every recipient before sending them SMS through the Service, for honoring all opt-out requests promptly, and for the content of every message you send. OmniBiz AI acts as a carrier-connected platform on your behalf and is not the sender of record for your campaigns.

6. AI-Generated Content

The Service generates marketing copy, emails, SMS messages, social posts, and voice scripts using AI. You are responsible for reviewing all AI-generated content before publishing or sending it. We do not guarantee the accuracy, completeness, or performance of AI-generated output.

7. Intellectual Property

We retain all rights to the Service, including its software, design, and branding. You retain all rights to the business and customer data you upload and the content you generate through the Service. You grant us the limited right to process your data solely to provide the Service to you.

8. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. Features dependent on third-party providers — such as SMS, email delivery, and voice providers — depend on those providers' availability and terms.

9. Limitation of Liability

To the fullest extent permitted by law, OmniBiz AI and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of revenue, customers, or data, arising from your use of or inability to use the Service. Our aggregate liability is limited to the amount you paid in the prior twelve months.

10. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms or pose a risk to the Service. Upon termination, your right to use the Service ends and we will remove your data in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will note the updated date above and notify you of material changes through the Service. Continued use after a change constitutes acceptance of the revised Terms.
